1. General Remarks

These general terms and conditions of sale and delivery (“Terms of Sale”) apply to your purchase of Santa Fee products and services, represented by Société 5 Sàrl, Rue des Prélets 22A, 2206 Les Geneveys-sur-Coffrane Switzerland at the Santa Fee Online Shop located at www.santafee.com. If you are purchasing at the Santa Fee Online Shop, you must agree to these Terms of Sale and indicate your agreement by clicking on the “I agree” button. If you do not agree with these Terms of Sale, click “I do not agree” and you will not be able to purchase Santa Fees products online. By clicking on the “I agree” button, you acknowledge that you have reviewed and consent to be bound by these Terms of Sale.Together with the description of Santa Fee products and services stated in your order, these Terms of Sale constitute the entire agreement between you and Société 5 Sàrl for your purchase of Santa Fee products. No amendment to these Terms of Sale shall be effective unless agreed upon in writing by you and Société 5 Sàrl.

2. Purchase Orders

Your order of a Santa Fee product only constitutes an offer to buy from Société 5 Sàrl in accordance with these Terms of Sale. Société 5 Sàrl reserves the right to accept or reject any order in its sole discretion. Société 5 Sàrl does not guarantee that any product or service listed on the website will be available for purchase. Upon receipt of your order, Société 5 Sàrl will send you an automated order confirmation that lists the details of your order. Your order is accepted by Société 5 Sàrl and a contract on the sale and delivery of the product is considered to have been formed only upon Société 5 Sàrl sending you a written order confirmation. The order confirmation does not have to be signed by Société 5 Sàrl and may be transmitted by e-mail. Once you have submitted an order, you may submit a request to make changes to your order, but such changes will not take effect unless Société 5 Sàrl provides written or electronically transmitted acceptance of your request. All offers of Santa Fee in the Online Shop are only available in quantities suitable for an average household per order and per product in the case of several orders.

3. Prices and Delivery Costs

All prices for orders submitted through the Bernard Favre Online Shop are based on the prices that are listed on our website at the time of your purchase. Bernard Favre reserves the right to list different prices for purchases instore and in the Online Shop.

4. Payment Terms

Unless otherwise agreed, all orders shall be paid at the time of purchase and prior to delivery. By submitting credit card information, you represent and warrant that you are at least eighteen years of age and have the legal authority to use the credit card that you submit for payment, and you authorize our use of such information in accordance with our Privacy Policy, including without limitation our provision of such information to third parties for the purposes of payment processing. Because Société 5 Sàrl uses a third-party payment processor to process credit card payments on our behalf, when you supply payment information in connection with a purchase you agree that Société 5 Sàrl is not responsible for the security of such information when it is in the control of the third-party payment processor.

5. Delivery

Delivery will be made to the delivery address indicated on your order. Delivery dates are only binding if Société 5 Sàrl has expressly agreed to them in writing. Otherwise, any delivery dates indicated on the website or on any order or other document provided by Société 5 Sàrl are estimates only. Delays in delivery do not entitle you to refuse to accept the product, to cancel your order or to claim damages. Partial deliveries are permitted and do not entitle you to refuse to accept the product.

6. Refund Policy

Société 5 Sàrl ensures that its customers are satisfied in all circumstances. In order to accomplish this, please consult our refund policy below :

Exceeding the delivery time
The delivery time is a maximum of 14 days from the date of the order. If this time limit is exceeded, the customer may request a full refund of his order.
Order error
When the customer has made an error in an order (reference, quantity, etc.) he must send his request within 24 hours to contact@santafee.ch. The customer may request a refund.
Major product defect
If the customer finds a major defect in the product, it will be replaced free of charge.

7. Benefit and Risk

Benefit and all risk of loss or damage to any product you order passes to you when the product is delivered to you.

8. Warranty

Santa Fee provides a twenty-four (24) month warranty for your Santa Fee product, from the date of purchase, under the conditions defined in this warranty. The Santa Fee warranty covers manufacturing and material defects which exist at the time the accessory was purchased. Throughout the duration of the warranty, you have the right to have any defect repaired free of charge, upon presentation of a valid warranty certificate. This warranty does not cover: Normal Wear and ageing. Damage caused by inappropriate use or misuse, lack of care, negligence and accidents (impacts, dents, scratches, broken glass, etc.)

9. Data Privacy

The Société 5 Sàrl Privacy Policy (“Privacy Policy”) is a part of these Terms of Use and is incorporated herein by this reference. By accepting these Terms of Use you agree to the collection and use of your information as described in the Privacy Policy on our website.

10. Force Majeure

Société 5 Sàrl shall not be liable for any loss or damage as a result of any failure to perform or any delay in delivery or installation due to any cause beyond Société 5 Sàrl’s control, including but not limited to acts of God, strikes or other labor difficulties, disruption of operations, natural disasters, war, epidemics, governmental acts or orders or transportation.

11. Partial invalidity

Should any provision of these Terms of Sale be or become ineffective, invalid or unenforceable, the validity or enforceability of the other provisions shall not be affected. In such a case, the parties shall agree on a valid and enforceable provision that is as close as possible in its economic equivalent to the ineffective, invalid or unenforceable provision.

12. Governing law & jurisdiction

These Terms of Sale shall be governed by and construed in accordance with the laws of the State of Neuchâtel, Switzerland without regard to conflict of laws principles.
